You acknowledge that VFW may use a third-party courier company to deliver the documents and passport to the relevant Embassy/Consulate/Diplomatic Mission and the return of the passport to VFW or you (as the case may be). VFW shall not be liable whatsoever to you for any passports or documents which are lost in transit by accident, theft, natural disaster or any other reason outside the control of, or not arising out of a wilful default of VFW. Furthermore, VFW shall not be liable for any loss or damage caused to you in the event that your documents or passports are lost, damaged or delayed by the courier company, whether such loss, damage or delay is as a result of negligence, accident or any other cause. In no event shall VFW be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever due to such loss, damage or delay of your documents and/or passport. Without prejudice to the aforesaid, VFW' exclusive liability in the event your passport is lost or damaged in transit, is limited to the cost of replacement of your lost or damaged passport and the visa fees paid by you, provided evidence of the cost of replacement of the passport and the receipt for the visa fees is provided to VFW.
